Medicare Opt-Out Option – UPDATE 7/5/2022
The On September 9, 2020, the proposed rule to implement Section 11 of President Trump’s October 3, 2019 executive order was sent to the Office of Management and Budget. OMB sat on the proposed rule — did not issue it or make it public — perhaps waiting to see if President Trump would be re-elected. Since he was not re-elected, the proposed rule was never released and never made public. “In January 2021, the Biden Administration withdrew the Trump order, thereby reestablishing that Social Security benefits may not be severed from Medicare Part A coverage,” per ElderLawAnswers.
Therefore, the CCHF drive to secure for seniors their inalienable right to receive their rightful Social Security Retirement Benefits without enrolling in Medicare through executive order will now be shifted to securing an Act of Congress: The Retirement Freedom Act authored by Republicans U.S. Senator Ted Cruz and Congressman Gary Palmer.
Medicare Opt-Out Option – UPDATE 4/8/20
We’ve got news, although not yet the news we wished for.
As you may recall, section 11 of President Trump’s October 3, 2019 executive order on Medicare required that the U.S. Department of Health and Human Services and the Social Security Administration work together to make sure that Americans who choose to opt out to Medicare would not lose access to their Social Security Retirement Benefits (SSRB).
The executive order had a 180-day implementation deadline, which was March 31.
There’s good news! Despite the coronavirus, we’ve been told they’re still working on it. Recently and over the past six months, we’ve been in contact with the administration and the White House. They’ve asked us some questions and we’ve given some advice and insisted on a few things. So progress is being made, but unfortunately, the opt-out option is not yet available. We have been told that deadlines in executive orders are sometimes not followed to the letter.
But here is an important fact: we are birddogging the issue, and have the support of high-level administrators to make this happen. So stay tuned. We’ll let you know as soon as we know.

Under President Trump’s October 3, 2019 Executive Order 13890, the administration has until March 31, 2020 to delink Medicare enrollment from Social Security retirement benefits (SSRB). Once the unlawful policies linking them today are rescinded, senior citizens may opt out of Medicare without losing their social security benefits and without being required to pay back all SS and Medicare benefits they have received to date, as current policies require.
